These Terms of Service (“Terms”) govern your use of the Speechkick mobile app and website (collectively, the “Service”) operated by Speechkick LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Speechkick is a communication development app that helps parents and caregivers track their child's speech and language milestones, access evidence-based activities, and build practical skills for everyday interactions. The Service is intended for use by adults (parents and caregivers) on behalf of children in their care.

The information and guidance provided by Speechkick is for educational purposes only. It is not a substitute for evaluation or treatment by a licensed speech-language pathologist or other qualified healthcare professional. If you have concerns about your child's development, please consult a qualified professional.

2. Accounts

To use Speechkick, you must create an account using your email address or through Apple or Google sign-in. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account.

You agree to provide accurate information when creating your account and to keep it up to date. We may suspend or terminate accounts that we believe contain false information or are being used in violation of these Terms.

3. Subscriptions and Billing

Free Trial

New users receive a free trial period. The duration of the trial is displayed at the time you sign up. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

Paid Subscriptions

Speechkick offers monthly and annual subscription plans. Prices are displayed in the app and on our website. Subscriptions renew automatically at the end of each billing period unless cancelled.

Billing

If you subscribe through the iOS app, billing is handled by Apple and governed by Apple's App Store terms. If you subscribe through the Android app, billing is handled by Google and governed by Google Play's terms. If you subscribe through our website, billing is handled by Lemon Squeezy. We do not process or store your payment card details directly.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then. To cancel:

Refunds

Refund requests for App Store and Google Play purchases must be submitted to Apple or Google respectively, as we do not control those transactions. For web purchases, contact us at support@speechkick.com within 14 days of purchase.

Price Changes

We may change subscription prices at any time. We will provide advance notice of price changes and they will not affect your current billing period. Continued use after a price change takes effect constitutes acceptance of the new price.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law
Share your account credentials with others or allow multiple people to use a single account
Attempt to reverse engineer, decompile, or extract the source code of the app
Use automated tools to scrape, crawl, or extract data from the Service
Interfere with or disrupt the integrity or performance of the Service
Attempt to gain unauthorized access to any part of the Service or its related systems

5. Your Content

You retain ownership of the data you enter into Speechkick — your child's profiles, tracked milestones, and notes. By using the Service, you grant us a limited license to store and process that data solely to provide the Service to you.

You are responsible for ensuring that any information you enter is accurate and that you have the right to enter it. Do not enter sensitive medical or therapeutic records beyond what is needed for tracking purposes.

6. Intellectual Property

The Speechkick app, website, and all content created by us — including activity content, strategies, guidance text, design, and branding — are owned by Speechkick and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Speechkick is an educational tool, not a medical device or clinical service. We make no representation that use of the Service will result in any particular developmental outcome for your child.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPEECHKICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50.

9. Termination

You may close your account at any time from the Profile tab in the app. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service, with reasonable notice where possible. Upon termination, your right to use the Service ends and we will delete your data in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or with a notice in the app at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in North Carolina, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.
